  • Hmmm...question about paying TOG...

    We booked our photographer about august last year and the VAT rate was 15%, we paid a £300.00 deposit and the final balance is now due at the end of the month. So, do I still pay only 15% VAT because I booked it and payed deposit last year or does it now increase to 17.5% anyway? Confused

    Did you sign a contract with the tog at the time stating the agreed price? if so then you pay the price as stated on the contract, we paid our tog a £100 deposit on booking and signed a contract we then paid in full before christmas and have no additional costs due to the vat incrase, infact he has kept his prices the same this year x

    I'd advise you to look at your contract. Our's just says what the amount due is - so I'm not expecting it to increase. Whereas our catering charges are net of vat so they'll go up (just hoping we don't have 20% by the time of the wedding!)

    We signed a contract so he cant change the price but VAT rates changing is not really him changing the price. The contract doesnt say anything about what happens when the VAT rate changes. We had an invoice before christmas which shows the price, the vat amount (at15%) and then the total, so not sure whether that changes or not. Im hoping because we booked and paid a deposit last year it wont change but I want to be sure.

    Maybe a TOG will be along soon, someone on here is bound to have people that booked last year so know what I should pay!

    Send him the money of the amount he totalled in december...all he can do is ask for more the extra vat rate.  if he then does ask for the increase tell him you understand thats what the total was according to the contract that had been signed.

    The way that the VAT man sees it is that for any services rendered after the 1st January 2010, VAT will have to be paid at 17.5%. All invoices raised now have to be at 17.5%. 

    From HRMC (pdf)

    "If you receive a deposit before 1 January 2010 for goods or services that you will supply on or after that date the 15% rate of VAT will apply to the deposit and 17.5% will apply to the balance."

    Hi urbanbridesmaid - so because the work is being done this year then I should pay 17.5%, but the invoice was raised last year in december at 15%. So does that now change to 17.5% because I havent paid it yet or 15% because its already been raised?

    This is hurting my head! lol!

    I'm a photographer but non vat registered so cannot help in detail, but we are talking about some fairly small sums here To be vat registered I will assume you are paying £1000 plus for the wedding thats only a £25 difference tax. 

    As has been said its down to your photographer how he handles this - He may just absorb the difference in price himself, you may have a clause in your contract to cover this ? 

    Either way you need to be happy before your wedding day

    It may 'only' be a £30.00 diference but thats still money that could be used else where and to me, its not a fairly small sum to pay out if I dont have to.

    oh Moya I'm sorry but I don't know!!!!!

    We agreed a figure with our photographer regardless of VAT or whatever.  We paid a 20% deposit when we booked and paid 80% remainder on Sunday.  No idea what he did with the VAT.

    Surely you agreed a price and you just have to pay the balance of whats left after your deposit has been paid???

    Hi Gillsy, thats what I thought but on the invoice from last year he has broken it down into price + VAT. I might just transfer the money at 15% VAT and wait and see if he says anything. ...hopefully he wont. I just wanted to be in the know in case he asked for the extra. I know its not a lot but at the moment we dont have wedding cars and Im working every hour under the sun so to us every penny makes a big difference!

    as Louisa says, the 15% VAT on your deposit remains the same. but anything you pay after that is legally charged at 17.5%. Whether your tog passes that on or not is up to him - pay what is in the invoice (at 15%) and hope he doesn't ask for more - however, if he does then you don't really have an argument as he is entitled to it. If you had paid the entire amount before the VAT went up, you could have paid it at 15% (that's what we did at our venue)

    The fact that your tog has itemised the VAT on your invoice suggests that they're VAT registered, and will therefore have to pay VAT of 17.5% on your balance.  However, if they've invoiced you based in 15% they may be absorbing the difference during this change over period.  Pay what they've asked for, and take it from there.
